Defaulted Ford Consolidated Direct Student LoansEdwards Finance > Student Loan Q. I have just received a notice of default on a consolidated William D. Ford Federal Direct Student Loan, although I have been making the payments. SInce I an not sure of the cause of this action, and I believe it was done illegally, I would like to know about others who have received similar notices, to gather evidence for a legal action (possibly as a class) against the U.S. Department of Education. A. -if you're not sure how it defualted then it must have been illegal. Here's an idea...before you sue them you could call them and find out why it defaulted. -You'll find that a lot of people have had similar bad experiences with loan servicers. A lawsuit may be better if you have sustained damages to your credit rating or otherwise, or if you want to insure that this won't happen again.
