Who can tell we about even Stop Foreclosure?Q. Does anyone know if there is sort of a consumer complaint "center" against BANKS, MORTGAGE LENDERS etc. This is happening to us and we need to act with everything we can find as part of their proceedings are not legit: Over the past 18 months we had some rough financial times as in me not working most of 1997 and then later my oplderst daughter had problems and her hospitalization etc. etc. Anyway we were late on every bill we had but only one month or so...but had to pay incredible late charges. We were always able to make payments but were just always running a couple of weeks behind and My husband';s payment method changed anyway to once a month...so there were always changes. Anyway, I heard about a "plan" that would allow us to skip a few months mortgage payment and we could catch up with everything and even set some money aside again (all gone now) and then be ahead of our payments each month, i.e. avoiding all late charges in the future!!!! That was the purpose of our inquiry and our bank offered it, they call it loan modification or work-out. Okay....so according to our bank we were to make one more payment (to be current) and then we could use the 3 to 4 months which we started to use as planned. They told us someone would get back to us a.s.a.p and would give us a YES or NO answer to application. Therefore, if their answer was a NO we could still make our regular payments...But we never heard back, we called and wrote and faxed and left messages with loan officers who were supposedly handling our records and NEVER EVER got a call back. I documented it all and kept receipts etc. We faxed and said that we would like to resume payments again because we did not need the plan anymore now but they would not accept our payment!!!!!!!!!!! Instead they outsourced our finacial application to a third party after sitting on our records for 3 months (and we constatntly calling), therefore, waited until we were in so-called default while leading us to believe we were making use of this wonderful break and now are trying to foreclose on our house unless we come up with the outstanding amount of 6000 Dollars (the plan we were supposed to have) or 139.000 within one month!!!!!! In other words we are being ripped off! I contacted Channel Four's Consumer Reporter Paula Lyons and she is interested in the case and I have talked to her already but we still have to get a lawyer and everything else to fight either way. Any info available? A. Are you saying that: 1. You couldn't make your mortgage pay't so applied to set up alternative arrangements. 2. Your application was not responded to so you stopped making payments anyway. 3. 3 months later, the mortgage co. started foreclosure proceedings due to nonpayment. 4. you decided you would start making payments to stop foreclosure and they wouldn't accept payment. If these are the facts, it sounds like typical foreclosure process and I don't see the rip-off. For sure, the mortgage co. should have, for customer courtesy, responded to your request for an answer, but you were obligated to make payments until you received an answer. The terms of foreclosure are written into your contract, I'm sure. I don't see any benefit for the mortgage co. to act fraudulently in this case--they don't normally enjoy foreclosure so why would they "set" you up for it? Am I missing something?
