Q. Voluntary Repo ? What is the statute of limitations for the credit company to come p/u a vehicle when bankruptcy has been filed and the creditor has not come to p/u the vehicle and or repo'd it. Creditor was notified 8 months ago that vehilce was voluntarly surrendered and the creditor has not come and p/u'd the vehicle.
A. - It looks like there is no statute of limitations in your state. Send them a certified letter requiring they sign for the letter, repeat your voluntary repo and give them a time limit to remove it, say 30 days from the date you receive the reciept, or it will be towed off at their expense since they will then be the owners of the vehicle - What is the statute of limitations for the credit company to come p/u a vehicle when bankruptcy has been filed and the creditor has not come to p/u the vehicle and or repo'd it. It is their problem if they do not collect it.
