The income tax is measured/calculated based on taxable income, and is levied against the individual or entity that earns/generates the income. Of course it doesn't matter what reality is, -That's contradicted by the regualation: “Sec. 1.1-1 Income tax on individuals. (a) General rule. (1) Section 1 of the Code imposes an income tax on THE INCOME of every individual who is a citizen or resident of the United States... The tax imposed is upon TAXABLE INCOME . . . In the case of a non resident alien receiving income from sources withn the United States, the IRS couldn't care less who the income recipient is. It charges those disbursing the funds with the responsibility of withholding the appropriate amount of tax. It's the taxable income that is taxed -- as the regulation says -- not the person. If that were not true, there wouldn't be millions of people who don't pay any income tax at all.
