Q. Can I File Against Payday Loans With Savings Account? Will Pay For Help! I am up to the wall with payday loans, some Checks some not, as well as other creditors, as a result of mistakes and hardships caused by the death of my First husband. I am obligated to pay more than I earn. I have to file bankruptcy NOW. I just closed my checking account leaving my savings account still open at same bank. With extension after extensions I have paid Well over the amount borrowed, and now owe more than the amount borrowed. There is a rumor at work that there is a class action lawsuit in the works here in Nevada against these Predators

A. Payday loans are one of the worst deals that have ever been permitted by any legislature. And bounced checks can be referred to the district attorney's office for prosecution. I suggest that you contact the lender in writing (use a fax with a confirmation report) and tell them your situation. Include your telephone number in your correspondence, so they can call you. If they do call you take notes and send them another letter summarizing the conversation (e.g., "This is confirm our telephone conversation of this date wherein you said X and I said Y.")(and get another confirmation report). They probably will not work with you, but you can never tell. Attempting to resolve this prior to bouncing checks will at least partially insulate you from claims that you're conduct was intentional. You may also want to familiarize yourself with the state law governing permissible payday loan practices ( http://www.leg.state.nv.us/NRS/Search/NRSQuery.cfm ). You may have counter claims against the lender. If that doesn't work contact a bankruptcy professional in your area. It doesn't have to be someone that adversities on T.V., in fact, I'd avoid those places (but I'm biased in favor of small firms). If you call a few you'll find someone that will talk to you at length about the next steps. Class action relief is not likely to help you in time, and even then future borrowers and the class action attorneys will reap most of the benefits. Please let the group know how it works out.
