Filing bankruptcy need help

Q. Well The wife and I have really been thinking about it and avoiding it. But The credit card companies are hounding us and our income went from 19,000 a year to who knows how low this year.We are just paying the rent and mortgage (manufactured house) We used the cards to buy little things we always did without. it was too easy. Now of course we cannot pay them. Hell We have not really been able to pay them for 2 years. and the payments we did make did not even pay off the fee's each month. We only owe about 4,000. We tried to sell our place but the realtor has not done anything and we singed a 6 month contract with her. So if we sold it without her we would have to pay her 5,200. Hell she has not called more then twice and has never shown our place once. We do not really have enough equity in our house to pay off the credit cads and have enough to move to another place. So From what I have read I really do need a lawyer as it can be complex. We really do not have any assets over 1,000 except our house. We do not even have a car. So it may not be real complex. any ideas or lawyers here in portland oregon to talk to that take small monthly payments?

A. First off, what the hell has that broker been doing ? Sitting on her hands watching Jeopardy? Tell her she signed a contract and expect to see some results. Now that I got that off, That's the problem with credit cards, you think the minimum is okay, but the minimum is going to keep you in debt for practically forever (Credit card companies know this and then get all pouty when bankruptcies go up, poor babies) If you only owe $4000, You may want to call CCS (Consumer counseling service) They are a national not for profit organization that will negotiate on your behalf to lower your credit card interest and fees and put together a spending plan to get you out of debt. They charge a small fee each month but usually it still comes out to less then you were paying originally. How much less I don't know. Call 800-555-1212 for the number of one in Oregon. (or check the phonebook). If that doesn't help, you can consider chapter 7 or chapt 13. Chapter 13 will let you keep everything you have but you have to make monthly payment to the Bankrutpcy trustee every month, for the next three years to pay off a percentage of your debts and live on what is basically a court approved budget. Once that's over, you free of all those debts. Chapt. 7 is what people normally think of as bankruptcy. There are laws regarding what you can keep and not keep. If you don't have any assets over $1000, then the only tricky part would be the house. I don't know the laws in Oregon. There may be a way to keep the house. Nolo Press had 3 really good books. Money Troubles, for dealing with creditors and especially credit card companies and collection agencies and also budgeting so there are no repeats. and 2 bankruptcy books one on Chapt 7 and one on chapt 13.
