Q. I have about 5800 in my checking account and plan on filing bankruptcy, should i continue paying my minimum payment or the credit cards that are over the limit? Can you file bankruptcy on the credit cards that are over the limit? Also I just recently transfered the 5800 into a different checking account so i would have money to live on in the summer- iam a teacher and get paid 10 months and a casino was going to take out 4500 from my checking and it bounced, should i talk to them about a payment plan or ignore them? When i file will they say that i had 5800 in my account and why couldn't i afford the monthly payments? my lawyer also told me that since i had no assests chapter 7 would be right for me and that i would never be able to file chapter 13 with my income and budget. he also told me to stop paying all together, what should I do about the casino? I am just wondering about the 5800 in my account and if they say that I planned on filing bankruptcy and opened a new account to keep the 5800? Also note that I am 52000 in debt with unsecured loans. I also owe 20000 on my vechile and have an unsecured loan with the same bank, the lawyer also stated that they could take my car in chapter 7 also, is that TRUE?
